Car Accident Not Your Fault? 4 Ways to Ensure You Get the Compensation You Deserve

A car accident can be terrifying—but it doesn't have to be unnecessarily costly. When you're injured in a car accident that was not your fault, there are several things you'll need to do to ensure that you're properly compensated. A failure to follow these steps could lead to taking on the responsibility of your medical bills and expenses on your own.

1. Take the Appropriate Steps to Document the Accident

Once an accident has occurred, you should immediately call emergency services. There are three things that you need to do to document your accident: file a police report, seek medical attention, and photograph the accident. Filing a police report will document the accident itself, while procuring medical attention will ensure that your injuries are documented. Visiting the emergency room quickly after the accident is highly advised.

2. Contact Your Insurance Company—and Only Your Insurance Company

Your insurance company will be your first line of defense when it comes to an accident. Your insurance company will ideally be working with you to procure compensation—though it shouldn't be assumed that your insurance company will be able to handle all your needs.

Most importantly, there's never any reason for you to talk to the other individual's insurance company, or the other individuals. Your insurance company will interface with them directly. It is better that you restrict your conversations to your insurance company and your attorney.

3. Work with a Personal Injury Attorney

Car accidents can lead to very severe medical problems. Unfortunately, the physical and financial consequences of these accidents may not be immediately obvious. In the case of severe auto collisions, a personal injury attorney is usually advisable. A personal injury attorney from Loughlin Fitzgerald PC or a similar firm is able to collect your documentation and determine a fair value for your settlement.

There are times when a personal injury attorney becomes necessary, such as when the other individual's insurance and your personal insurance coverage have both been exceeded or are trying to deny your claim. In these situations, hiring in attorney is likely the only way to procure your settlement.

4. Document Any Associated Costs

The costs of an auto injury go beyond simply the medical expenses. They also include lost wages, physical therapy, medical supplies, and any other expenses that would not have otherwise been required. Thorough documentation of these costs will be necessary for you to procure the fairest settlement amount.

A personal injury lawyer can advise you through every step of the above process. But, in general, the most important thing to remember is to document everything and to discuss the accident only with emergency services and your insurance company.
